If you are considering bankruptcy call an attorney. However, before meeting with an attorney you should prepare for the bankruptcy.
1. Stop using your credit cards. Debt is not dischargeable (or deletable) If you borrow money with the intent of having the debt discharged. Consult with us before incurring any more debt.
2. Gather all your documents. Collect all your current bills, current paycheck stubs, your federal and state income tax returns, 1040s and W2s, appraisals and information on your property. If there is a question as to whether an we may need it, grab it. We will sort it out with you later.
3. Do not transfer or gift property out of your name. Doing so before filing bankruptcy can be considered a fraudulent conveyance, which may have the effect of disqualifying you for bankruptcy protection.
4. Prioritize your debts for possible payment. Rent, utilities, car and mortgage payments must be paid currently, however paying credit card accounts that will be discharged wasting your money.
